Is property bought before divorce and at separation considered community property? Since many months can pass while a couple is separated. It's not unusual for one spouse to buy property during this time. But how will this property be handled during the divorce? Will it be considered marital property which will be divided in you divorce? Also I have a girlfriend, together for about 2.5 years. We are about to brake up now days. can she claim on the property? He and his wife had a fight on their first overnight(wife called the cops) and my daughter's dad went to jail. They were fighting in front of our daughter. The cps contacted me and we had a case open for 31 days. Things progressively got worse, and I knew nothing about my daughter's dads behavior with our daughter and his wife UNTIL three days ago. She ended up leaving him and now telling me everything he did. I have the proof from her, that he would cuss, yell, lock our daughter in a closet while he slept, treat her harshly for playing with a toy "the wrong way", and even say things like, "she can sit in her own ****". He even told his wife he would shoot himself if she called the cops on him. I went today and got an ex parte filed with family law facilitators(waited outside the courthouse at 5 am for two hours and got seen at 8:30 am), and I had police reports, counseling papers, journal entries, testimonies, and more from his wife today that I included as exhibits for the Judge. I didn't ask for full custody, but I only asked that my daughter's dad get supervised visitation(out of his pocket), extensive DV classes because Marine Corps only made him take a ONE day class, and a parenting class. I wonder, can I still ask the judge at our court hearing on Tuesday if I can get full custody even though I didn't put that in when I was filing with the family law facilitator? I want to. I don't have a lawyer because I could not afford one. I also had to go to FAMILY LAW FACILITATOR as I stated int eh above details. I couldn't get advice, but I did get help with filing paperwork out to file for ex parte. I tried Legal Aid and they say the wait is 31 days, my court date is in 5 days. Also, My daughter cries to this day when going to her dad. I always thought it was because she just had a stronger bond with me and is clingy. She never wants to go to him and repeatedly says "no daddy no" I never assumed he was doing all this, but only what he has told me "I'm just more strict with her" |

There's even a commercial I've seen that promote a man doing what his wife wants. I plan on having a lavish lifestyle with an Art Deco home and beautiful car. One of the things I don't hope is that my wife (if I get one) for out of nowhere will try to make me give up all the stuff I worked for, and do what everything she wants just so she gets what she wants . Sadly, it is for the same reasons as the last divorce. I did not know until recently what my father did to both of these women until recently.To both women, my mother and step-mom, he has had multiple affairs on them , stole their money physically and through the divorce, lied to them on multiple accounts, has been physically and mentally abusive to them continuously, has tried to kill one of them. Overall he cheats, lies, and abuses. The sad thing is that he accuses both of them, even my mother, of doing the same things(minus the murder), even going so far to paint a bad picture of them in front of his family, their friends and even strangers. I saw some of this take place. He denies everything, and tells me all that both women say is lies. I am a bit lost and not sure who to believe. I assume he is pulling the wool over my and everyone's eyes. How do I deal with my father, who is incredibly eager to put forth his own story, when I can barely talk to him due to the fact he wants to get his side out and make me believe him, and the fact I do not want to deal with him currently? Also, can anyone be persecuted for this kind of thing, this "serial divorce" I guess you can call it? Overall, how can I cope, understand why my father does what he does, and how to get past him as he is now? |

He's supposed to see him every other weekend and that's fine. Since last weekend was a holiday he took him then as well, so that would be 2 weekends in a row. He stated that he wanted him yet again this weekend. That would be 3 in a row. Our son does not wish to go again this weekend and frankly the weather is going to be nasty and its just ridiculous. He has always been on the chubbier side, and I am perfectly okay with that. I don't find him any less attractive, but I have become concerned with his unhealthy habits. He is not very active and tends to eat a lot of junk food, expectally when I'm at work (I'll find the fast food wrappers when I clean the house). His weight has become noticeable and I've noticed he is starting to get winded very easiely. Diabetes runs in his family, and I've tried to tell him that he should see a doctor, but he refuses to listen and believes he is healthy. I don't have any children with my husband, we've been married less than a year. All I have connected to him are a bank account and his last name, but that shouldn't be a reason to leave somebody. Here are things that I can do -nevermind I don't really have anything that I can do. Here are things I can't do (P.S. We live In a small town with around 10 thousand people) -go anywhere outside of the house without one of my parents watching me (like even the backyard) -close the bathroom door at any time -close the bedroom door -be in my room without someone in there with me -stay home alone when she/he are at the grocery store or when they're at their restaurant. He doesn t want me to have any friends or talk to anyone, the only person he doesn t mind me talking to is my kids. He went out all day yesterday and had drinks with friends. I was upset because he doesn t allow me to do those things but he does those things. I wanted to go out and shoot some pool and have a few drinks at a pool hall very close to home, het told me I couldn t go unless he came so he did. He had an attitude much of the night and then we went to one more place and went home. I had to much to drink. when we got home we had another argument. He snatched off my hair piece in front of our neighbors. I was very upset. Then he locked me in the house and wouldn t let me leave. I fell down and hurt myself pretty bad. He didn t hit me or push me or touch me. I was feeling threatened though and I called the police. The police came, but he left. For some stupid reason he came back knowing the police where here. They wanted to take him to jail for domestic violence but I didn t let them because he didn t physically hit me and I thought that would be wrong of me. He had some warrants so they took him to jail for that. Now I feel awful. I know he is extremely controlling but I love my husband and I want to make things work. I feel like part of this is my fault because I drank to much and maybe I over did it with the arguments. I don t know. Do you think our relationship can recover? Thanks Ryde but you really don't know my situation and it really isn't fair to judge. He kept begging for me back and his life isn't nothing without me. But can't seem to cut her off or stop sleeping with her. I told him we can work things out but cut her off he said I can't it'll make things awkward at work. So I dumped his *** and now taking him to court. Like she's ok being the side ho . After I dumped him and put child support on him, he changed he started calling me names and being hostile towards me and our baby. My wife is always complaining that we're not having enough sex but she doesn't like to make any of the first moves. We've only had sex once in the past 2 or 3 months. When I get home at night my wife loves to make me sit on the bed with her so she can lay her head on my shoulder. That gets annoying after a while cause when you're trying to clean up the kitchen, work on your laptop or just play on your tablet she's there like a wet sponge. You can't move cause she gets annoyed when she can't lay on you in some way. Well, when she lays on my shoulder she likes to try and touch my penis. Not that it's a problem but I know that's as far as it's going. No need in just touching it if you're not going to put it to work. Well, all night she kept trying and trying until I started to grab her breasts. She'd push me away. After we went to bed and the lights were off I tried to snuggle up to her and caress her breasts. She was ok with me just putting my hand on it but when I tried to go under her shirt I got shut down. This is what she told me. "I haven't showered yet."
